FORMA NATURA Online Store Terms and Conditions and Newsletter Policy
Effective for agreements concluded from January 1, 2021, for privileged Entrepreneurs.

§1 DEFINITIONS
Business Days – days from Monday to Friday excluding public holidays.
Consumer – a consumer within the meaning of the Civil Code.
Buyer – any entity purchasing in the Store.
Privileged Buyer – Consumer or Privileged Entrepreneur.
Privileged Entrepreneur – a natural person entering into a contract directly related to their business activity, but not for professional purposes (definition valid for contracts concluded from January 1, 2021).
Terms – these Terms and Conditions.
Store – the online store FORMA NATURA operated by the Seller at https://www.formanatura.pl.
Seller – TOMASZ MIZGALSKI, conducting business under FORMA NATURA Tomasz Mizgalski, registered in the Central Registration and Information on Business, NIP 1132420018, REGON 361538004, Jawornik 187, 38-114 Jawornik, Poland.

§3 TECHNICAL REQUIREMENTS
To properly use the Store, you need:

a device with Internet access
-
a web browser supporting JavaScript and cookies
To place an order, you also need an active email account. -

§4 SHOPPING IN THE STORE
Prices shown in the Store are total prices for the goods.
The total price includes the price of the goods and, where applicable, delivery costs.
Add the selected product to the shopping cart.
Choose the delivery method and payment method and provide the required information.
Placing an order is done by confirming the order details and accepting the Terms.
Placing an order constitutes the conclusion of a sales agreement between Buyer and Seller.
The Seller shall provide the privileged Buyer with confirmation of the contract on a durable medium no later than upon delivery.

§5 PAYMENTS
Payments can be made via the payment platform Przelewy24.
For prepayment, the payment term is 7 Business Days from the order date.
Some payment methods must be paid immediately after placing the order.
The Buyer accepts electronic invoices but may withdraw consent.

§6 ORDER FULFILLMENT
The Seller is obliged to deliver defect-free goods.
Delivery times are indicated in the Store.
For prepaid orders, fulfillment begins after payment.
If multiple goods have different delivery times, the longest term applies.
Delivery is only within Poland.
Delivery methods include InPost parcel lockers.

§7 RIGHT OF WITHDRAWAL
Privileged Buyers may withdraw within 14 days without giving reasons, subject to §8.
The period expires 14 days from receiving the goods (or last of multiple items).
To exercise the right, the Buyer must inform the Seller via a clear statement (email or mail).
A template withdrawal form is provided but not mandatory.
Sending the withdrawal notice before the deadline is sufficient to preserve the period.
Effects of Withdrawal
The Seller refunds all payments, including standard delivery costs, within 14 days, using the same payment method unless agreed otherwise.
The Seller may wait until goods are returned or proof is provided.

The Buyer bears direct return costs and only compensates for diminished value due to improper use.
Certain goods may have higher return costs indicated in the Store.

§8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
No right of withdrawal applies to contracts for:

non-prefabricated goods made to Buyer specifications
-
perishable goods or those with short shelf life
-
sealed goods not returnable for health/hygiene reasons once opened
-
goods that naturally merge with other items
-
audio, visual, or software in sealed packaging once opened
-
newspapers, periodicals, except subscriptions
-
prices dependent on financial market fluctuations beyond Seller's control

§9 COMPLAINTS
Defective goods can be claimed under statutory warranty or manufacturer guarantee.
Claims include price reduction, withdrawal, replacement, or repair.
Warranty period: 2 years from delivery.
Entrepreneurs must examine goods timely and notify the Seller.
Complaints should be sent to Seller via email or post.
If necessary, goods must be delivered to Seller, at Seller’s cost for privileged Buyers.
Additional guarantees are listed in product descriptions.

Complaints are handled within 14 days.
OUT-OF-COURT COMPLAINT RESOLUTION
Consumers may use mediation, permanent consumer arbitration, municipal or district consumer protection offices, or the ODR platform: https://ec.europa.eu/consumers/odr/main/?event=main.home.howitworks.

§10 PERSONAL DATA
Seller is the data controller. Detailed information is in the Privacy Policy.
Data is processed for order fulfillment, legal obligations, or legitimate interests (Art. 6 GDPR).
Providing data is necessary to conclude a contract.
Data retention lasts until contract completion, legal obligations end, or claims expire.
Buyers may request access, correction, deletion, restriction, data portability, or object to processing.
Complaints about data may be submitted to the President of the Office for Personal Data Protection.

§11 PROVISIONS
Illegal content is prohibited.
Each order constitutes a separate agreement.
Contracts are concluded in Polish.
In disputes with non-privileged Buyers, jurisdiction is Seller’s location.

§1 DEFINITIONS
Consumer – within Civil Code definition.
Newsletter – free electronic service delivering Store-related information.
Privileged Entrepreneur – same as above.
Store – https://www.formanatura.pl.
Subscriber – anyone using the Newsletter service.
Privileged Subscriber – Consumer or Privileged Entrepreneur.
Provider – TOMASZ MIZGALSKI, FORMA NATURA, Jawornik 187, 38-114 Jawornik, Poland.

§2 NEWSLETTER
Subscription is voluntary.
Requirements: device with updated browser supporting JS and cookies, Internet, active email.
Subscription constitutes a service agreement.
The Subscriber must provide a valid email.
Messages include opt-out information.
Unsubscribing is free at any time via link or email to sklep@formanatura.pl.

§3 COMPLAINTS
Complaints to: sklep@formanatura.pl
Resolved within 14 days.
Out-of-court dispute resolution: mediation, permanent consumer arbitration, municipal or district consumer offices, ODR platform.

Provider is data controller. Details in Privacy Policy.
Data processed for sending Newsletter (contract and legitimate interest, Art. 6 GDPR).
Providing data is necessary for service.
Data retention: until unsubscription or expiration of claims.
Subscribers may request access, correction, deletion, restriction, data portability, or object.
Complaints to Personal Data Protection Office.

§5 FINAL PROVISIONS
Provider may change the policy for important reasons (law changes, service modernization).
Subscribers will be notified at least 7 days in advance.
Lack of objection implies acceptance; objection leads to service termination.
Illegal content prohibited.
Contracts are in Polish.
Disputes with non-privileged Subscribers: jurisdiction of Provider’s location.
